If you are the parent of a child, New York law says you are responsible for the financial support of that child until the child is 21, even if you have never lived with the child or do not live with the child now.

Both parents are legally obligated to support their children. New York guidelines for determining the child support is as follows:

  • For one child, the guidelines start at 17% of combined parental income, allocated between each parent in proportion to their respective incomes;

  • For two children, the percentage is 25%;

  • For three children it is 29%; 31% for four; and 35% for five or more.

    Several issues are considered when determining what should be included as income, for child support purposes, and what should be deducted.

    The parties are permitted to "opt-out" of the guidelines, by agreeing on a different amount of child support. If they cannot agree, then the courts will generally use the guidelines in determining the amount of child support to be paid by the non-custodial parent to the custodial parent.
